Terms of Service

1. Agreement to Terms

By accessing or using VibeAny ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. License Grant and Restrictions

The Service provides browser-local video clipping and MP4 export. Portions of the video processing implementation may be adapted from GPL-3.0 ffmpeg-webCLI sources and are provided with the required notices and source availability.

You may not:

  • Use the Service to process content you do not have the right to use
  • Attempt to bypass credit limits, payment checks, or account controls
  • Remove GPL or open-source notices from adapted source distributions
  • Misrepresent exported content as owned by you when it is not
  • Use the Product in any way that violates applicable laws
3. User Accounts

When you create an account with us, you must provide accurate information.

You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to terminate accounts that violate these Terms or are inactive for extended periods.

4. Payments, Access, and Refunds

Credit Pack Purchase

Paid usage is sold as one-time export credit packs through Creem. One successful MP4 export uses 1 credit. No subscription is required for the MVP.

Credit Delivery

After successful payment confirmation or webhook processing, credits are added to your account balance.

Refunds

Failed exports automatically refund the reserved credit when the browser reports the failure. Payment refunds may be issued for accidental duplicate purchase, technical issues preventing access, or as required by law.

To request a refund, please contact us at [email protected] with your order details and reason for the refund request. We will review each request on a case-by-case basis.

Price Changes and Discounts

Prices and discounts may change over time. Any changes do not affect past purchases.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code or malware
  • Engage in unauthorized access or hacking
  • Harass, abuse, or harm others
  • Spam or send unsolicited communications
  • Impersonate others or misrepresent your affiliation
6. Intellectual Property

The Service and its original content, features, and functionality are owned by VibeAny except for open-source components governed by their own licenses.

You retain ownership of content you process using the Service. Source videos are processed locally in your browser and are not uploaded to our servers for clipping.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN ALL CASES, OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE PRODUCT IS LIMITED TO THE AMOUNTS YOU PAID FOR THE PRODUCT.

9. Indemnification

You agree to indemnify and hold harmless VibeAny from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

As we operate globally, we comply with applicable consumer protection laws in your jurisdiction. If you are a consumer in the European Union, United Kingdom, or other regions with mandatory consumer protection laws, you retain the rights granted to you under such laws, and nothing in these Terms shall limit those statutory rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitutes acceptance of the new Terms.
